Terms and Conditions for Guests Renting a Bright Holiday Homes property

1. Agreement Overview
By booking and occupying the holiday property ("Property"), guests agree to abide by the following terms and conditions. These terms form a binding agreement between the guest ("Guest") and Bright Holiday Homes ("Bright Holiday Homes") for the rental period.

2. Booking and Payment
a. Booking: The booking is considered confirmed once Bright Holiday Homes receives the required deposit or full payment, and the Guest receives a booking confirmation.
b. Payments:

  • 50% deposit required within 48 hours of booking being made to consider your reservation confirmed.
  • Balance due 21 days prior to arrival date. Failure to make balance payment may result in booking being cancelled.
  • Bookings made within 21 days of arrival date will require full payment at the time of booking.

Full payment is due prior to check-in. Payments are accepted via our Gateway Portal or direct deposit. Any payment failures may result in cancellation of the reservation.
c. Security Deposit: Bright Holiday Homes requires all guests to complete a Guest Registration Agreement prior to check-in. This form will include your credit card details, which will be securely stored on file for the purpose of processing payments related to your booking. This may include accommodation charges, security deposits, incidentals, and any damages or additional fees incurred during your stay. Your credit card details will be handled with the highest level of security and confidentiality, in compliance with applicable data protection laws. No unauthorized charges will be made without prior notice. By proceeding with your booking, you acknowledge and agree to these terms.

3. Check-in / Check-out
a. Check-in: Check-in time is from 3pm on the arrival date.
b. Check-out: Check-out time is by 10am on the departure date. Late check-out will incur additional charges unless prior arrangements have been made in writing.

4. Guest Responsibilities
a. Occupancy: The maximum number of guests allowed varies by property. Please refer to the specific listing for details on sleeping capacity. Exceeding the stated limit is prohibited. Additional charges will apply if the bedding used exceeds the allocated amount based on the number of guests noted in your booking without prior notification to Bright Holiday Homes.
b. Conduct: The Property must be used for lawful, quiet, and peaceful purposes only. Bright Holiday Homes reserves the right to terminate the rental agreement if the Guest's behavior disturbs neighbours or violates property rules.
c. Cleanliness: The Guest agrees to keep the Property in a clean and orderly condition during their stay.
d. Property Care: The Guest agrees to respect the Property and its contents. Any damages or breakages must be reported to Bright Holiday Homes immediately. The Guest is responsible for the cost of repairs or replacements.
e. Smoking and Vaping: Smoking and vaping are not permitted inside any of our properties. Additional cleaning charges will apply to remove odors.
f. Pets: Pets are only allowed if specified on the individual property listing and in the booking agreement. Unauthorized pets will result in additional charges or eviction in the event that the property booked is not pet friendly. Where applicable, you will be required to sign a pet agreement prior to commencement of your bookings.

5. Use of Facilities
a. Amenities: Guests are allowed to use all provided amenities, any damage to amenities must be reported immediately.
b. Safety: Guests are responsible for using the Property and amenities in a safe manner. Bright Holiday Homes is not liable for any injury, loss, or damage to guests using the Property.
c. Prohibited Activities: The Property must not be used for parties, events, or large gatherings without prior consent. Loud noise and disruptive activities are prohibited.

6. Cancellations and Refunds
a. Cancellation Policy: Cancellations must be made in writing to Bright Holiday Homes. Cancellation fees are as follows:

  • Full refund, less administration fee of $100.00, if cancelled more than 21 days before arrival date.
  • 50% refund if cancelled within 15 – 21 days before arrival date.
  • No refund if cancelled within 14 days before arrival date.

*If the reserved property can be re-booked for the same period and value, Bright Holiday Homes agrees to refund the portion of payment that can be recouped, less administration fee of $75.00*

If you booked through a third-party site such as Airbnb and Stayz, their cancellation policy will take precedence. Please review and understand the policy you agreed to at the time of booking**

b. Bright Holiday Homes Cancellations: If Bright Holiday Homes cancels the reservation due to the property being unfit for rental, a full refund will be provided, or the Guest may reschedule for another available time.

7. Liability
a. Damage: The Guest agrees to accept full liability for any damages or loss to the Property or its contents caused during their stay, and to reimburse Bright Holiday Homes for any repairs or replacement costs.
b. Bright Holiday Homes Liability: Bright Holiday Homes is not liable for any injuries, losses, or damages to the Guest or their belongings during the stay, except where the law requires such liability.
c. Exceptional Circumstances: Bright Holiday Homes is not responsible for events beyond their control, such as natural disasters, fires, pandemics, or government-imposed restrictions, that may prevent or disrupt the stay. If guests are unable to travel to Bright or the surrounding areas, or if they are required to vacate a property due to government-imposed restrictions, Bright Holiday Homes will allow the reservation to be deferred for up to 12 months at no extra cost.

8. Insurance
 Bright Holiday Homes recommends that the Guest acquire travel insurance to cover cancellations, medical emergencies, accidents, and property damage during their stay.

9. Privacy and Data Protection
 Bright Holiday Homes respects the privacy of the Guest and will handle personal data in accordance with applicable data protection laws. The Guest’s personal information will not be shared with third parties without consent, except as necessary for booking confirmation and payment processing.

10. Indemnity
 The Guest agrees to indemnify and hold Bright Holiday Homes harmless from any and all claims, damages, or expenses arising from their use of the Property or violation of these terms.

11. Amendments
 These terms and conditions may be updated by Bright Holiday Homes at any time. The updated terms will apply to all future bookings and stays.

By confirming the booking and/or checking in to the Property, the Guest acknowledges and agrees to the above terms and conditions.
